Most of the time it's going to be difficult. Shooting people in the water after their ship got blown up is THE example of what a clearly unlawful order is though. No gray area there, just black and white.

Doubt it. It's lose-lose. When Dems voice even the slightest critique of the media the media uses that opportunity to bash Democrats instead of reporting on Republicans.

But that's exactly the point of the "purity testing" narrative. Accusing people the left disagees with, even if it's only on policy details rather than the goals, don't have any principles at all or are corrupt/shills/ghouls.
That "sense" is sometimes even justified by deliberate misinterpretation.

Sorry, but this doesn't address the question of fairness at all. And as argument for trans inclusion it's actually harmful. The easiest answer on how to distinguish between trans and cis women not to allow any gender change in birth certificates or other official papers. Better not promote this.

It's about the principle of looking at the big picture and imagining a new system from the ground up.
Of course you can use existing administrative structures. And you'd have to go through Congress both for establishing a team like this and to make any changes based on the ideas developed there.

Different level. Have some (temporary) team that doesn't focus on existing structures that have grown piece by piece over 100+ years and on implementing laws but takes a fresh look on big structures in order to propose major legislative changes.

Valuable work but also more bureaucracy. You'd probably need a different team to do what Pete is dreaming of, an evaluation of the whole structure of the federal government, how departments are set up, and the interaction between departments, with other governments, and with citizens.

He was frustrated with the difficulties to work across departments for example, duplicate structures, and how difficult it was to make any changes in his own.
Obviously most of his ideas would have to got through Congress.

Pete was already talking about the need for more substantial reforms, including changing the portfolio of departments, when he was running for president in 2020 rather than just making the existing system more efficient and that sentiment got a lot stronger while he was in the cabinet.
