It's important to name the tools of authoritarianism so we can identify and condemn them with precision. I'm glad we now have a term for ICE's openly racist, degrading immigration arrests: Kavanaugh stops. slate.com/news-and-pol...

In the short time since Kavanaugh wrote that opinion, his assertions have been proved demonstrably, almost laughably false too many times to count. As Sherrilyn Ifill notes, the justice’s claims were already belied by the factual record in that case, which showed ICE agents violently harassing and detaining American citizens for extended periods simply because they are Latino. Now the agency, freed from constitutional restraints by SCOTUS, has stopped pretending to be engaged in anything other than racial profiling. Bovino’s admission only confirms what we already knew: These detentions, far from the “brief” inconvenience Kavanaugh described, are often lengthy, violent, and dangerous. Ifill and Anil Kalhan, a professor of law at Drexel University, have proposed calling these detainments “Kavanaugh stops,” a label that’s quickly catching on.

For too many political reporters, the way someone makes the argument – how nice they look, how erudite they sound, how polite they seem – has long taken precedent over the actual argument itself.

Their rule of thumb seems to be that, as long as the tone is cheerful, there's no need to examine the ugliness of the words. As long as the speaker is smiling, there's no need to hear what they say.

But a true reckoning with the life and legacy of any political activist – no matter where they stood on the spectrum – has to address the substance of their words and deeds, and not just their style. Focus on exactly what they said, not how nicely they said it.

Justice Sotomayor, not mincing words, also says that today's decision will lead to the "creation of [] a second-class citizenship status" for Latinos, who now will have the burden to "carry enough documentation to prove that they deserve to walk freely."

The concurrence relegates the interests of U. S. citizens
and individuals with legal status to a single sentence, positing that the Government will free these individuals as
soon as they show they are legally in the United States.
Ante, at 8 (opinion of KAVANAUGH, J.). That blinks reality.
Two plaintiffs in this very case tried to explain that they
are U. S. citizens; one was then pushed against a fence with
his arms twisted behind his back, and the other was taken away from his job to a warehouse for further questioning. More fundamentally, it is the Government’s burden to prove that it has reasonable suspicion to stop someone. The concurrence improperly shifts the burden onto an entire class of citizens to carry enough documentation to prove that they deserve to walk freely. The Constitution does not permit the creation of such a second-class citizenship status.

To put this into context, the judicial warrant for the search at the Hyundai plant named just four people.

Relying on that warrant, ICE detained nearly 500 people. DHS admitted that included U.S. citizens, permanent residents, and people lawfully here on visas.
