Detailed response and corrections here to the argument that withdrawal would not have an impact on the GFA by @colinmurray.bsky.social and @aoifemod.bsky.social

A new Explainer out from @aoifemod.bsky.social and me detailing the UK's ECHR commitments under the 1998 Agreement in response to recent speculation. It is short, because there is very little to say - the UK's obligations are evident on the B/GFA's plain text:

"Does taking the UK out of the ECHR breach the Belfast/Good Friday Agreement?"

Yes.

"But what if..."

No. It breaches the Agreement.

"Ok, but..."

No. Unless your position is "renegotiate with Ireland and conclude a new Agreement including NI parties", it is a breach.

In jumping off the precipice of ECHR withdrawal, the Conservative Party is aping - and legitimising - a policy which in the rest of Europe is only espoused by the far right verfassungsblog.de/badge-of-dis...

All of these institutions, by the way, supported by ECHR rights providing for fair treatment.

Following ECHR debate, imagine if "reform is hard, so just remove it without replacing it with anything else" was policy applied to other foundational parts of the state, governance and law - like the NHS, the police or education?

"Does the ECHR stop states from controlling their borders?"

No. The ECHR Court emphasises migration policies are up to states themselves.

"But the ECHR stops the UK from deporting foreign criminals."

No, it doesn't.

Successful human rights-based appeals against deportation are very rare.

Vernon Bogdanor isn't wrong to flag the ECHR's importance given the minimal constraints on Westminster's legislative power. And that rights matter for minorities. But they matter for everyone - they are a cornerstone to the legitimacy of a system of government:

A must read from @colinmurray.bsky.social and @aoifemod.bsky.social correcting the record on the Belfast/Good Friday Agreement and the European Convention on Human Rights.

From myself & @colinmurray.bsky.social on the European Convention on Human Rights & very briefly (bc it is clear) why it is not plausible to claim that it is possible to leave & not breach the 1998 Good Friday/Belfast Agreement.

A new report by @colinmurray.bsky.social and @aoifemod.bsky.social explains claims the UK could leave the ECHR without breaching the Good Friday Agreement are “not credible.”

The front cover of CAJ's newest publication titled "The Belfast/ Good Friday Agreement 1998 and the European Convention on Human Rights: Explainer". The cover includes this title as well as a partially covered image of 'The Treaty Series' agreement for the Belfast Agreement.

The news of Conor Gearty's death has just been announced and I'm not coping. He was a mentor and the pole star in my constitutional thinking. He was also a great friend and fantastic fun to be around. I'm heartbroken for Aoife and the children.

It is important to realise how outlandish it is to suggest that the UK leaving the ECHR does not undermine the B/GFA 1998. As @joellegrogan.bsky.social and @alicedonald.bsky.social point out, it would rip up an essential element of this peace agreement:
