Should the UK leave the European Convention on Human Rights?

Interesting comments from Dominic Grieve, former Attorney General for England and Wales👇

At our recent event, our trustee @alicedonald.bsky.social spoke about the power of economic and social rights, not just to protect people in times of hardship, but to help everyone thrive.

At Just Fair, we believe these rights should work as both protection and empowerment. 🌍⚖️

In jumping off the precipice of ECHR withdrawal, the Conservative Party is aping - and legitimising - a policy which in the rest of Europe is only espoused by the far right verfassungsblog.de/badge-of-dis...

"Does the ECHR stop states from controlling their borders?"

No. The ECHR Court emphasises migration policies are up to states themselves.

"But the ECHR stops the UK from deporting foreign criminals."

No, it doesn't.

Successful human rights-based appeals against deportation are very rare.

Important to hear Hilary Benn affirm, in his Labour Conference Speech, that the official position is that the UK leaving the ECHR would indeed undermine the UK's commitments under the Belfast/Good Friday Agreement 1998:

The Conservatives look set to announce withdrawal from the #ECHR as policy.

This reckless move would fly jn the face of evidence both as to the benefits of ECHR membership and the costs of withdrawal - including to efforts to control irregular migration

Starting this Sunday, the UK Conservatives will hold their annual party conference and possibly adopt a new flagship policy: withdrawal from the ECHR.

That would legitimise the playbook of the far-right, warns ALICE DONALD (@alicedonald.bsky.social).

Quote from our post by Alice Donald: “Pushback against the ECtHR over immigration is neither new nor confined to the UK. But what once sounded like fringe rhetoric is now being echoed at the very centre of British Politics.”

This outstanding point-by-point rebuttal is the final word in correcting the foolish and nonsensical Policy Exchange report - thank you @colinmurray.bsky.social @aoifemod.bsky.social

A new Explainer out from @aoifemod.bsky.social and me detailing the UK's ECHR commitments under the 1998 Agreement in response to recent speculation. It is short, because there is very little to say - the UK's obligations are evident on the B/GFA's plain text:

A must read from @colinmurray.bsky.social and @aoifemod.bsky.social correcting the record on the Belfast/Good Friday Agreement and the European Convention on Human Rights.

Vernon Bogdanor isn't wrong to flag the ECHR's importance given the minimal constraints on Westminster's legislative power. And that rights matter for minorities. But they matter for everyone - they are a cornerstone to the legitimacy of a system of government:

🚨New report finds UK media often misleads on immigration & the ECHR.
From the bogus “chicken nuggets” deportation story to judges labelled “enemies of the people,” coverage creates a toxic “data fog.”
We ask co-author Prof. @alicedonald.bsky.social can PSBs cut through the pollution? 🎙️

There is a serious failure in UK govt, politics & media to take sufficiently seriously what Musk said & meant with "fight back or die"

= Violence (interethnic civil war) is inevitable so pre-emptive violence - vs migrants, minorities & political opponents - is necessary to avoid existential erasure

The common sense meaning should make this Elon Musk's "rivers of blood" moment

Though I think he goes further than Enoch Powell in a couple of important ways

Elon Musk spoke by video to Tommy Robinson's anti-immigrant rally in the UK today.

"You're in a fundamental situation here where, whether you choose violence or not, violence is coming to you," said Musk. "You either fight back or you die."

"Reform has touted its plan as a “legal reset”. But it is better understood as a total rejection of the UK’s postwar international commitments to protect the human rights of everyone within its jurisdiction."
Treaties like the ECHR protect everyone in the UK, not just migrants
These commitments have cemented the UK at the heart of the rules-based international order.

It is important to realise how outlandish it is to suggest that the UK leaving the ECHR does not undermine the B/GFA 1998. As @joellegrogan.bsky.social and @alicedonald.bsky.social point out, it would rip up an essential element of this peace agreement:
