I spent the week at the police surveillance convention and let me tell you my biggest observation: The name of the game now is consolidating as much information as humanely possible from surveillance devices, the internet, other governmental data, and literally a million other places. 🧵

The relationship with the OLC at times is “not normative”, and citing the issue of torture during the rendition programme. It may seem small, it may seem technical and internal - but JAGs seem to have pushed back. Authority demands leadership.

We all know that there has been failures on that level, we’ve all (at least most on my list) have worked on that. But there’s something very telling about public and grandiose statements about threats demanding deployment and what can and should happen in response.

Trump’s public statements being chaotic and often out of bounds as commander in chief was necessarily going to strain any relation he would have with JAGs - or at least most of them - as anything must be fact based, because so is the law.

A lot of discussion regarding the targeting of KSTs - the infamous imminent threat outside of an active theatre - “you can’t target someone just because you put a terrorist label on their head”. Effectively, this is a conversation about consistent military leadership in times of instability.

Another JAG comment on the deployment of the National Guard in CA - citing the Posse Comitatus, which I’ve done before - “needs to rest on assessed threat, and not facts that are found on TruthSocial”, which reflects the most recent ruling citing the Trump decision as “untethered to the facts”.

The apparent disinterest in this overt, blatant authoritarianism can’t be justified by self-interest alone. The unwillingness to dissent even in the most basic of ways needs to be examined in the broader light of what we expect from constitutional enforcement

At a talk with JAGs / former JAGs and very interesting to hear how they worked under Trump 1 (“not sure how we were supposed to react to a 2am tweet”) and the importance of reading the Constitution before claiming to serve it. Quite timely.

It’s really hard not to give in to hopelessness in moments like those. I’ve written about it at length trying to really focus on what justice would look like, could but most importantly should look like. So many also were under the age of 3. I’m glad, however, that a news outlet published it.
