Trump, in his official capacity as President of the United States, et al., Appellants BEFORE: Henderson*, Pan**, and Garcia, Circuit Judges ORDER Upon consideration of the emergency motion for a stay pending appeal, the opposition thereto, and the reply, it is ORDERED that the administrative stay entered on September 2, 2025, be dissolved. It is FURTHER ORDERED that the motion for stay be denied. The government seeks the "extraordinary" relief of a stay pending appeal. Citizens for Resp. & Ethics in Washington v. FEC, 904 F.3d 1014, 1017 (D.C. Cir. 2018) (per curiam). To secure that relief, the government must show that it will face "irreparable injury" if the district court's order is not stayed while the appeal is pending. Nken v. Holder, 556 U.S. 418, 433-35 (2009). That injury must be "both certain and great," and "of such imminence that there is a clear and present need for equitable relief to prevent irreparable harm." Chaplaincy of Full Gospel Churches v. England, 454 F.3d 290, 297 (D.C. Cir. 2006) (cleaned up). The government has not met that burden on the facts of this case. Indeed, it has not made a meaningful attempt to do so.
