I have never seen him suggest that we should "wait" until we live in a fascist state. Just the opposite. He thinks we need to act now to prevent one from forming. He worries that if people think we're already there, they may give up and stop resisting. Not sure I agree, but I respect his views.

It depends what you're in for. If youre arrested for being undocumented (not a crime), then your access to food, water, showers, attorney contact, and due process are denied. If you're in for sex trafficking and rape of children in a criminal ring involving the president, then puppies no problem.
