We have NEW research on pregnancy-related prosecutions in the first two years after Dobbs, and there are surely more cases.

They show us that giving rights to fertilized eggs, embryos, and fetuses paves the way for people to be ARRESTED and PUNISHED for all pregnancy outcomes — beyond abortion.
In the two years after Dobbs, prosecutors initiated at least 412 cases charging people with crimes related to pregnancy, pregnancy loss, or birth. Prosecutors criminalized 31 people who experienced a pregnancy loss in the 2 years after Dobbs. Pregnancy related prosecutions happened in 16 states. These were the top 3: Alabama, Oklahoma, and South Carolina. Most cases involve allegations of substance use during pregnancy - 399/412

Most cases began in a medical setting - 264/412

Get up — the ABA passed a resolution to help protect pregnant people❗We hope it is just the first of many steps toward ensuring that pregnant people can live with safety and dignity.

No one should be punished because of their actions during pregnancy, or for any pregnancy outcome.
The American Bar Association (ABA) passed a resolution against laws that punish people for their actions during pregnancy.
Resolution 518 states how the  criminalization of pregnancy:
- threatens fundamental rights
- stops individuals from seeking medical care, and
- worsens maternal and infant health outcomes. Text from Resolution 518: 
RESOLVED, That the American Bar Association opposes the application or adoption of laws imposing civil or criminal liability for any actions taken by an individual based on the potential, actual, or perceived impact on their pregnancy, its outcomes, or their health; and
FURTHER RESOLVED, That the American Bar Association urge the adoption and faithful execution of laws that prohibit civil or criminal liability for any actions taken by an individual based on the potential, actual, or perceived impact on their pregnancy, its outcomes, or their health.

The ABA is sending a clear message: oppose pregnancy criminalization. We commend the ABA for this step toward legal and policy change to protect pregnant people.
