So long as our fields are shrinking and we continue to hire fresh PhDs to tenure-line positions, the idea that there is much of any meritocracy to be found is a sick joke.

the roberts court, even when it isn't playing outright calvinball, has been AFAIK extremely consistent in giving corporations every break possible so in my mind it doesn't even matter if its a live question or not.
