Viewpoint discrimination is very much an established thing in First Amendment law.

Slow walking these appeals right to January 21, 2029.

Yeah. This makes sense when it's an exit row.

Now we’re stuck in Denver to refuel. Flight attendant tells me they can’t charge dude’s credit card a premium seat fee while we’re in the air and it becomes a safety issue when a person in exit row won’t comply.

If he had gone to biz class seat instead, they could have dealt with it after flight.

I suspect the problem is that when you won't comply with FAs' instructions, that makes you a security threat, and that's why they diverted.
smmarotta.bsky.social
Ah, but then the local rule is contradicted by a standing order that is issued routinely at the start of a case and you just need to call it to mind whenever you file a document.

You're a bit far, but I do it by Zoom, too!

[email protected] got me donuts for my birthday (yesterday) and the class sang. It was delightful. And special shoutout to the first question from a student, which was "How do you know each other?" which allowed us to tell the story of #AppellateTwitter.

TFW the great @smmarotta.bsky.social takes time out of his crazy busy schedule to teach your students about personal jurisdiction. Sean is a mensch and Civ Pro rockstar, and my students and I had the BEST time! ❤️

When the plans get out of the DM and you actually go visit @marinklevy.bsky.social and her class. I had the BEST time.

What character-and-fitness committee is going to bat an eye at an SSRI?

Come on, people.
smmarotta.bsky.social
Raffi. No.

I'm starting to think a good law school exam would be "produce a single draft that accurately reflects the comments you've received" and the question is a single word document with tracked changes from 8 different people at unspecified times interspersed with comment bubbles.

I was thinking of the Guard.
smmarotta.bsky.social
I mean, the answer is pretty much yes, because we have a National Guard that is professional and focused on duty. So I get the joke, but the fact our military is not a bunch of mercenaries is why respect the Guard.

At Duke Law today. Can't wait to talk to @marinklevy.bsky.social's class later.

I love this very much for you.

Understanding who I am and what gives me joy and loving it out loud is the best thing I've done in life.

You think dressing up in Star Wars outifts and going to Disney and having Star Wars patches on a briefcase is dumb?

Okay. But it makes me happy.

I'm celebrating 41 today and have the health to work on, but, truly.

The greatest gift in my life is the time and resources to spend with the people who matter the most to me, including (and perhaps especially) dear friends who give me joy and who are not geographically proximate.

After sort of a base level of financial security,
If you are lucky enough to get that, the really important things are time and health.

Those who are 35+, what advice do you have for people just entering their 30s?
smmarotta.bsky.social
Thank you, friend! So glad I got to meet you in person!

"The Supreme Court shall hold at the seat of government a term of court commencing on the first Monday in October of each year and may hold such adjourned or special terms as may be necessary."

I support free expression.

But.
smmarotta.bsky.social
I'm not saying I agree with that view. I'm just saying that's a coherent position one can take whereas the "a single district judge" rhethoric doesn't make much sense.
smmarotta.bsky.social
If you want to say the judiciary isn't competent to assess the legality of the National Guard being federalized, fine, but that isn't an issue of "a single district judge."
smmarotta.bsky.social
I've never understood the rhetoric of the "single district judge." Is the idea that three of them can? A court of appeals panel? Who, exactly?

WAITER: We're all out of Diet Coke. Is Coke Zero okay?

STEVEN MILLER: This is a Leftist, Communist treasonous conspiracy. America was built on Diet Coke. For ourselves, for our children, and for our Republic, we CANNOT shy away from using force to see this blight on our country destroyed.
