TBC I'm not claiming the party written about behaved well. Also it seems there was an error by the IPO in granting the original trade mark. Examination standards have ime gone downhill in the last few years. But ultimately the right outcome was reached.

It sounds as if it didn't get that far, but settled first*. The IP system rightly gives time for parties to settle before a court case.
