Smith is allowed to hold whatever views she likes, but she isn't allowed to vilify or harass people. That's what this case was about. She didn't just politely express an objection to trans women playing in sport.

One of the most bad-faith assumptions made by TERFs is that cis girls/women only begrudgingly accept the presence of trans girls/women in their spaces. Most cis women I know would be made way more uncomfortable by an anti-trans policy than by the presence of a trans woman.
