If Idaho could charge in Ruby Ridge, it seems hard to say Illinois’ hands are tied from charging here.
yeasting.bsky.social
If it weren’t for fear of ICE immunity claims, this kind of conduct would ordinarily be charged as aggravated battery here.

Why there’s no charging is a question for the Cook County State’s Attorney and the state AG.

I so barely qualify as an author.
(I got co-author credit on a pop nonfiction book when I was an undergrad, umm, 25 years ago)
But I'm doing it anyways.

There are paths in Illinois law that can be used to charge some federal officers with state offenses in some circumstances. But, I haven’t seen anything from the State’s Attorney suggesting she’s interested in having that option.
yeasting.bsky.social
There are paths available now!

Even if the State’s Attorney were afraid to directly confront feds, maybe she could put each of these agents before a cc grand jury to testify braggingly about how Martinez purportedly assaulted them?

In detail. Lots of discrete yes/no questions with details.

Ok, I'm reading this elegant complaint as a historic document, while nervous about what's to come.

But, can we talk about the "Chipocalypse"/"Philocaly's" typo in paragraph 86?

John Roberts: Good morning, counsel. Before we begin, I understand that there is an update to the caption in this case?
Me: Yes, your honor. My client recently changed their name.
JR: Alright. And what is your client's new name?
Me: Webster Bivens, your honor.
JR: <covering the mic> oh shit

Who gets to make students write up whether requiring private owners to allow ICE agents to use their restroom is “quartering”?

My hunch was that ISP’s presence at protests was supposed to be just a memo to be delivered some time next to some district court.

But, the governor didn’t think through that cops can’t help but act like cops.

Relinking the full decision here. If you've made it all the way down to the end of this thread, thanks for following along. I obviously am not endorsing every word of Judge Young's decision, even though I believe his opinion is worth highlighting. storage.courtlistener.com/recap/gov.us...

But how could we do anything about it if we don’t have a precise, justiciable test to tell us that democracy is in trouble.

Oh, you have tests? Never mind. I’ll retire.

I would take this more seriously if I knew State AG or Cook County State’s Attorney was involved and willing to charge.

Who’s writing the jurisprudence explaining how state courts can read Supreme Court decisions narrowly and skeptically as the Supreme Court’s legitimacy falls apart?
yeasting.bsky.social
Would like to see this courage in other blue states’ courts— instead of uncritically reading state law rights in “lockstep” with Roberts Court’s constitutional interpretations, as if SCOTUS decisions still had some morally persuasive force.
