Enjoyed discussing redistricting wars, voting rights, and communities of interest today at Widener Delaware Law School. As a redistricting nerd, I was energized but the legal audience found the relative lack of national guardrails normatively depressing.

Technically Davis v. Bandemer (1986) said partisan gerrymandering was justiciable, and then Rucho (2019) strongly disagreed and overturned. But in practice, both cases affirmed and kept in place partisan gerrymandered maps.

The R gerrymander in 1980s Indiana worked as expected in the aggregate, but some R incumbents lost unexpectedly along the way to the gerrymander. In Davis v. Bandemer (1986), SCOTUS allowed partisan gerrymandering and it was affirmed again in Rucho (2019).

As Indiana is pressured to redistrict by White House, state legislators may recall Davis v. Bandemer (1986). Rs gerrymandered legislature in 1980s but in several seats Dems surprisingly won later due to Rs spreading out R voters across many districts. supreme.justia.com/cases/federa...

Smart article from @calmatters.org on "gut and amend," which has been used regularly in CA legislature for decades. The CA Supreme Court overturning that procedure would have huge ripple effects on other laws, so this legal challenge is unlikely to prevail. t.co/E2bFUbcbZj

INTRODUCTION
What is at stake here? Nothing less than the future of Texas. If a
small fraction of recalcitrant lawmakers choose to run out the clock
today, they can do so for any, and every, Regular or Special Session, potentially bankrupting the State in an attempt to get their way. That means every state budget could be held hostage until the whims of a small fraction of legislators is satisfied. It doesn't have to be that way.
The rarely used writ of quo warranto exists to solve rare problems such
as this. And this Court exists to solve cases with ramifications far
beyond the individual parties to the case. So here too, the Court's decision will determine if only one-third of the Legislature can dictate the outcome for 100% of Texans.
