So how do we do this? Presumably by tightly binding physical identity to your device and then proving possession (with some other bells and whistles). Not coincidentally that’s exactly what age verification is. Weird how corporate and gov’t priorities suddenly align, right?

Again, there is a logical end to race-based redistricting: when racial voting is no longer present. Indeed, in some places *today* there is no VRA Section 2 claim because there isn't racially polarized voting

Kagan is stating in the 1982 reauthorization of the VRA Congress specifically rejected intentional discrimination as a VRA standard in response to a prior Supreme Court case (City of Mobile v. Bolden, 1980)

Keep in mind Roberts wrote a DOJ brief opposing the 1982 reauthorization

Perry called everyone in to make a disclosure. After listening to 9th Circuit oral arguments on Nat Guard over the weekend, Perry says one of her clerks realized the government had taken a position there
"inconsistent" with what had been said in Perry's courtroom.

That frustrated law clerk texted someone they "believed" to be another law clerk, but who turned out to be a "friend of theirs who works at the Illinois attorney general's office."

That clerk realized what they'd done within about 90 seconds, deleted/edited the message and asked the friend if they'd read it. The friend said they'd "seen enough to know it was not meant for them."

Bottom line: Perry says that clerk will no longer be working on this case, going forward.
Neither side made a motion based on this disclosure, but I didn't hear anyone rule it out, either.
Either way, hearing adjourned.
