But, the conservative SCOTUS majority wants it both ways. Obedience by lower courts to hasty rocket docket decisions and refusal to address then, slow walking scheduling of full hearings on merits.

The conflict here is that the justices aren’t using the emergency docket as a temporary tool, they’re making “precedent” and expecting lower court judges to apply it without explanation. This is why we’re seeing so much frustration from lower court judges.

No institutional design can overcome a lawbreaking president, a Congress defending lawbreaking and forfeiting its own power, a Supreme Court that pretends legal text doesn’t count to facilitate lawbreaking, and a citizenry that votes for all that.
Need at least one that wants rule of law. Maybe two.
