By my count: Of the 15 Departments of the US Government, 13 launched new BlueSky accounts tonight (all but Justice and HUD), and all 13 have posted explicitly partisan political posts blaming Democrats and/or Chuck Schumer for the government shutdown.

In tonight’s hearing, Illston reiterated a question that raised eyebrows earlier in the week.

“Are you still unwilling to discuss the merits today?” Illston asked the DOJ lawyer.

“I’m not prepared to discuss the merits,” the lawyer, Elizabeth Hedges, replied.

The RIFs — reductions in force — are mass firings that can, if properly implemented, be carried out by the federal government.

Illston’s TRO blocks them during the shutdown as being likely illegal — “the epitome of hasty, arbitrary and capricious decisionmaking” — as to the union plaintiffs.

Second, the Trump admin argued the original TRO allowed the RIFing of people whose positions the Trump admin has tried to block from being unionized (EO14251).

Illston sided with the plaintiffs, though, and will be covering bargaining units removed under the EO that are subject to legal dispute.

Earlier this week, Judge Susan Illston issued a TRO blocking shutdown RIFs affecting AFSCME and AFL-CIO members and bargaining units.

Today, upon plaintiffs’ request, she expanded that on two fronts:

She added three unions to that coverage. They are NFFE, SEIU, and NAGE.
