He would not be in prison right this second bc he'd be out on appeal.

Yeah, I also find the silence about Miller a likely fiction.
Two notes on this filing:
1. DOJ is embracing Katsas's "there was no violation of Boasberg's order" theory for the inevitable SCOTUS appeals.

Kash is wrong. According to some of the criminal cases already charged, other-state Guard are operating under their governor's authority. These were WV officers, far from home.
