This is why I think the next Democratic president needs to use the EXACT tools that SCOTUS has handed Trump. Don't leave room for any distinctions.

Impound funds for deportation. Give ICE the USAID treatment. Refuse to collect government-backed debt. Purge MAGA loyalists from the executive branch.

What an utter disgrace. Noem's actions to "vacate" Secretary Mayorkas' grant of TPS over the direct command in the statute that no early termination can be done was flagrantly unlawful. And yet the majority offers not a SINGLE word of explanation for why they think she could do that.

In March of this year, the United States District Court for the Northern District of California entered a preliminary order postponing the effective date of the Secretary of Homeland Security's decision to remove "temporary protected status" (TPS) from Venezuelan nationals living in the United States. See 8 U.S. C. §1254a; 5 U.S. C. §705.
In May, this Court stayed that order while the Government appealed. The United States Court of Appeals for the Ninth Circuit ultimately affirmed the District Court's preliminary order. Last month, the District Court entered final judgment in respondents' favor, holding unlawful and setting aside the Secretary's actions effectuating her decision— namely, her vacatur of a pending extension of TPS for Venezuelan nationals, and her termination of that status itself.
See 5 U. S. C. §706(2). (The District Court also concluded that the Secretary unlawfully vacated a TPS extension for Haitian nationals. The Government now seeks to stay the portions of the District Court's judgment pertaining to Ven-ezuela, but not Haiti. See Application 7, n. 6.)
The application for stay presented to JUSTICE KAGAN and by her referred to the Court is granted. Although the posture of the case has changed, the parties' legal arguments and relative harms generally have not. The same result that we reached in May is appropriate here. NOEM v. JACKSON, J., dissenting
The September 5, 2025 order entered by the United States District Court for the Northern District of California, case No. 25-cv-1766, is stayed as to the Venezuela vacatur and Venezuela termination, pending the disposition of the Government's appeal in the United States Court of Appeals for the Ninth Circuit and disposition of a petition for a writ of certiorari, if such writ is timely sought. Should the petition for a writ of certiorari be denied, this stay shall terminate automatically. In the event certiorari is granted, the stay shall terminate upon the sending down of the judgment of this Court.
JUSTICE SOTOMAYOR and JUSTICE KAGAN would deny the application.

Surreal moment for America. Needless to say, if the normal police ever pulled something like this — pulling every single person out of an apartment building and handcuffing them to run warrant checks — they would be sued into oblivion.

Yet ICE is going to get away with it entirely.
"It was scary, because I had never had a gun in my face," Fisher said. "They asked my name and my date of birth and asked me, did I have any warrants? And I told them, 'No, 'Ididn't."
Fisher said she was handcuffed before being released around 3 a.m., and she was told that if anyone had any kind of warrant out for them, even if it was unrelated to immigration, they would not be released.

Nobody cares about the victims in the Dallas ICE shooting apparently. The first I've heard about one of them was on CNN today. He's fighting for his life in the hospital --- he was brought to the US when he was 13. He's 33 now. No criminal record.

I just don't know what to say anymore.

So according to the Supreme Court, Congress can't enact a line-item veto because that violates the Presentment Clause, meaning it's up to the President (or the Court) to invent his (its) own line-item veto. Do I have this right?

WOW. The lead plaintiff is a Latino man who's been here legally for 24 years. He was grabbed off the street by plainclothes federal agents who didn't even ASK about his status.

He was detained overnight and only released once a supervisor realized he had been illegally arrested.
PARTIES3. Plaintiff José Escobar Molina is a 47-year-old man who has lived in D.C. for 25 years. He has maintained valid Temporary Protected Status (“TPS”) for El Salvador since 2001. On August 21, 2025, Mr. Escobar Molina was walking from his apartment building in Northwest D.C.to his work truck, about to start his workday, when two cars pulled up next to him. As he was about to get into his truck, plain-clothed and unidentified federal agents exited the cars and—without conducting any inquiry—seized Mr. Escobar Molina, grabbing him by the arms and legs and immediately handcuffing him. The agents arrested him without a warrant and without asking for his name, his identification, or anything about his immigration status. The agents also did not ask him where he lives, whom he lives with, how long he has lived here, or anything else about his ties to the community prior to arresting him. After ICE detained Mr. Escobar Molina overnight at its processing center in Chantilly, Virginia, the next day an ICE supervisor finally realized that he had valid TPS, which statutorily prohibits ICE from detaining him, and released him. Due tohis Latino ethnicity, Mr. Escobar Molina fears being arrested and detained again while going about his daily life in D.C.

They threatened this before. It's not legal. The statute requires visas to be issued "in the order in which petitions are filed for such visas or status." A random lottery accounting for the impossibility of determining the exact filing order is one thing. 1/
