More evidence that some Border Patrol agents enjoy physically harming other people.
A video from inside a Border Patrol vehicle shows agents chasing a US citizen for filming them. The citizen refused to get out when they illegally ordered him to stop. The agents say: "This is great." "This is fun." "He's going to get shot."

National Guard aren’t ICE or Border Patrol. They didn’t sign up looking to harass and repress people. They’re volunteers, part time, in case of emergency. They didn’t ask for this.

West Virginia National Guard shouldn’t have been deployed in Washington DC.

UPDATE: In DOJ's request to block Judge Cobb's order that would end troop deployment in DC as of Dec. 11, the DC Circuit has ordered a response by Dec. 2, with any reply by Dec. 3.

The panel includes Katsas and Rao — the two Trump appointees who had the contempt appeal — and Millett (Obama).

The Trump administration has reacted to a small scale lone wolf attack by in DC announcing a sweeping collective punishment, using the organs of government to heap blame on partisan rivals, and potentially dissuading anyone from collaborating with US forces abroad for a generation.

The motion itself contains no references to today's shooting, and there is no reason to believe that the lawyers even knew about the shooting when they filed it.

The framing of this — linking the appeal to the shooting — seems disingenuous to me.

The DOJ filed a notice of appeal to Jia Cobb’s ruling yesterday. Appeal was going to happen regardless.
The Trump administration filed an emergency motion today asking a federal appeals court to halt a judge's ruling from last week that deemed the president's deployment of the National Guard to D.C. unlawful.

This kind of speech is more fundamental to First Amendment law than anything I can think of right now

I just feel awful for the National Guard troopers caught up in this. They’re just standing around looking bored all the time, but they have been made into a deliberate symbol by the Trump admin and that may have made them a target for this gunman.

We really do have two different kinds of law now: District Court law (aka the law), and Supreme Court "law" (aka the U.S. House of Lords upholding Trump's personalist regime)
I don’t know what the Supreme Court will do, but I am confident that at the District Court level it is still the case that the Pentagon cannot recall a sitting US Senator to active duty in order to court martial him for something he said. Article 1, Section 6, among other constitutional provisions.
