Ninth Circuit just ended appeals from denial of anti-SLAPP motions in federal court, overturning 20+ years of precedent. From a practical standpoint, massively consequential case. From a principled standpoint, major blow to free expression. Bad.

One of the hallucinated case citations was to the Mata v. Avianca AI hallucinations case?!?!

So this is another AI-generated incorrect cite?

I would LOVE if Lattarulo's lawyers could get info on the record about whether ICE got into the phone, or failing that, if a Boston journalist could dig into this a bit further.

The reason I am concerned (other than on behalf of Mr. Lattarulo's clients) is that threat modeling around device seizures requires understanding what is possible with locked devices! If ICE can gain access to information on locked and encrypted modern iPhones, that's a big deal.

(It should go without saying, but I will say, that the entire episode is deeply chilling and fucked up, and very much reads as trying to chill Lattarulo from his continued advocacy against ICE on behalf of his clients. I'm really glad he's fighting back.)

Or that they got his passcode/pin some other way/it was weak enough to brute force, which is certainly possible.

But it feels weird to have this entire debate about whether ICE can use the information on his phone without clarity as to whether they even got anything from it!

It's possible that DOJ doesn't want to say whether ICE actually can unlock or access information on the phone. Or that they don't know, and the fact that plaintiffs seem to think they can prevents the issue from being brought up directly.

Plaintiffs are concerned that they might already be accessing the information on the phone, and defendants are taking the position that they shouldn't be prohibited from doing so.

...but if the phone is a locked iPhone 15 Pro Max, it's not clear to me that ICE can even access decrypted info?

Subsequent back and forth in front of Judge Burroughs has centered on what ICE can do with the information that it may have seized from Lattarulo's phone, including the concern that they may mine his contacts or gain access to confidential information.

According to the complaint, Andrew Lattarulo had a iPhone 15 Pro Max according to the complaint. He didn't provide his passcode when his phone was seized, nor did ICE request it.

I've been following the Lattarulo case involving the seizure of an immigration attorney's cell phone at Logan Airport (complaint: storage.courtlistener.com/recap/gov.us...) pretty closely and I'm left with a big question that none of the coverage has answered.
