Ninth Circuit just ended appeals from denial of anti-SLAPP motions in federal court, overturning 20+ years of precedent. From a practical standpoint, massively consequential case. From a principled standpoint, major blow to free expression. Bad.

The reason I am concerned (other than on behalf of Mr. Lattarulo's clients) is that threat modeling around device seizures requires understanding what is possible with locked devices! If ICE can gain access to information on locked and encrypted modern iPhones, that's a big deal.

(It should go without saying, but I will say, that the entire episode is deeply chilling and fucked up, and very much reads as trying to chill Lattarulo from his continued advocacy against ICE on behalf of his clients. I'm really glad he's fighting back.)

It's possible that DOJ doesn't want to say whether ICE actually can unlock or access information on the phone. Or that they don't know, and the fact that plaintiffs seem to think they can prevents the issue from being brought up directly.

According to the complaint, Andrew Lattarulo had a iPhone 15 Pro Max according to the complaint. He didn't provide his passcode when his phone was seized, nor did ICE request it.
