The precursor to the Insurrection Act, which President Washington invoked to call up militia during the Whiskey Rebellion in 1794, required concurrence of a Supreme Court Justice that an insurrection was occurring.

DOJ is basically arguing in Court that if the President "determines" that literal martians have landed from Mars and are attacking the United States, Trump can invoke any emergency power he wants and the judiciary can't question it.

Kids, for a brief moment in July 1994, it looked like CBS and QVC were going to merge, with Barry Diller (who helped launch Fox in the 80s) taking over as head of CBS.

But then came a plot twist: Comcast decided it wanted QVC. With the help of another cable giant, it got it.
CBS Inc. and QVC Network Inc. confirmed yesterday that they were close to fashioning a merger that would bring together the network of Walter Cronkite and "Murphy Brown" and the company that put round-the-clock shopping into the nation's living rooms.
CBS's controlling shareholder and chairman, billionaire investor Laurence A. Tisch, declared that he was committed to completing a cash-and-stock deal with QVC that would be valued at $7.5 billion.
CBS "will not be shopped" to other bidders, Tisch said, in an unwitting pun on his intended partner. Many Wall Street analysts, however, predicted that other suitors for CBS would emerge.
The merged CBS-QVC would be run by Barry Diller, currently QVC's chief executive and a man widely considered one of the shrewdest creative minds in television history.

COMCAST'S BID TO BUY QVC DERAILS MERGER WITH CBS
CABLE FIRM MAKES SURPRISE $2.2 BILLION
OFFER

CBS Inc. last night said it has dropped its plan to merge with cable shopping network
QVC Inc. after a second cable company, Comcast Corp., made a surprise $2.2 billion bid for QVC.
Comcast's offer came on the eve of votes by the boards of QVC and CBS that would have likely approved their merger. But Comcast's offer of cash and stock valued at $44 per share was deemed more attractive than the complex package that CBS was offering QVC shareholders.
