Flock Safety can try to deny that its ALPR network was used by a Texas sheriff to investigate a woman who had an abortion, but newly obtained records show that it was, in fact, a "death investigation" of a non-viable fetus.

Deputies even considered charging her for it.

This was done at the direction of Pam Bondi. The US government is now dictating what apps you can have on your phone.

The underlying threat here is if Apple didn't comply, they'd slap billions in tariffs on Apple products.

Me too! I sharply disagree with this. I think this particular case is only about author's rights -- though I don't think that should matter either. I had a student write a paper about this last semester and was really disappointed to learn how many courts find Pico in whole to be nonbinding.

Yeah, sadly this court has consistently found, relying on 11th Cir precedent, that Pico, being only a plurality opinion, has no precedential value. Here's what this court said in its first ruling on a motion to dismiss last April (this is 731 F.Supp.3d 1298)

In normal times, we free speech folks use the hypothetical "government that doesn't respect norms or value freedom of expression and uses every lever it has to silence speech that threatens its own power" to emphasize the importance of limiting controls on speech. It's not hypothetical anymore.

For context, as far as I know not a single one of the many many deplatforming lawsuits ever brought was successful. As a practical matter, there is very little risk of losing one of these and almost certainly not a $24 million risk.
