Those anomalies are real people who would have to live with a binary definition classifying them wrong. And many intersex conditions are in the grey area between male/female, and are not a third sex.

Have you ever heard of the concept ‘Lies to children’? If you have to explain a very complex topic to someone who knows nothing about it (like children), you use metaphor and simpler models to help them understand before moving on to the more accurate version.

Are you defining sex by gamete production? Because if so you are leaving out people who produce neither.

I don’t think a medical definition is needed. Anything related to sex that is medically necessary would just be listed independently, as sex=female could mean someone who can/can’t get pregnant, has various anatomical anomalies, has xx chromosomes or xy (swyer), so just listing sex doesn’t mean much

My point is that even if it’s anomalies, there are people to who the binary chromosomal definition of sex don’t fit. If a xx for women xy for men definition is signed into law, pregnant people with swyers would legally be men, some people with chimerism would be classified as both.
