It is definitely different when the Court is telling a despot that he can do despotic things. When a court loses legitimacy by seizing power, you can just say no. When they lose legitimacy by abdication, it's tougher.

They are, and the consequences are extremely dire, but that pales in comparison to the much bigger problem: we don't have a legitimate president of the United States right now. What we are to make of his enablers and supporters who have thereby also delegitimized themselves is a secondary problem.

Its formal opinions have more sway but eventually you get enough "The President is literally above the law" and "but the Fed is different" and "well I mean if the President says John Roberts is dead, we have to defer to executive fact finding" and you start seeing district courts openly defying.

So, I'm not sure. Maybe the court has some practical legitimacy. Maybe it's still hanging by a thread. But we've already seen district courts defy them to the extent that they're ruling through unexplained shadow docket nonsense. And we've seen the Court get pissy about it.
