A new White House memo says that furloughed federal workers aren't entitled to back pay.

This is clearly against the law, which guarantees furloughed federal employees back pay for the duration of a government shutdown.

Makes me wonder if any of these brain donors are MDMP’ing the most likely points of failure and the most catastrophic potential consequences (not that they care).

Gaming this out, if the admin deploys A/C units the model would probably be a multi state JTF using the same authorities as JTF-SB (currently under the 10th MTN).

As these deployments are (for now) performative they could stage and deploy without invoking the Insurrection Act initially.

Judge: That's what I'll do. Prohibit federalization or deployment of any NG troops into Oregon. For all reasons in prior opinion. Deployment of federalized military is ultra vires and contrary to law, violating Title 10, section 12406. I also find it's likely that defendants violate 10th Amendment.

And the cherry on top of this shit sundae is that deployed ARNG soldiers (along with the rest of the military) won’t be paid as long as the federal government is shut down. Hopefully that will be less than 30 days.

If 400 soldiers from the Texas ARNG are mobilized under title 10 they will be in same boat as other active duty service members who won’t be paid as long as the federal government is shut down.

Nothing is too good for the troops and nothing is what they’ll get.

The very first statute authorizing domestic use of the military during domestic emergencies, enacted in 1792 by a Congress full of the same folks who wrote and ratified the Constitution, expressly provided for judicial review in certain circumstances *before* the President could even send troops.
