Now consider the much more robust Insurrection Act. That “Act” (it is really the product of several statutes enacted mainly over the course of the nineteenth century) provides, in relevant part and with emphasis added, the following:

10 U.S.C. §252. Use of militia and armed forces to enforce Federal authority

Whenever the President considers that unlawful obstructions, combinations, or assemblages, . . . make it impracticable to enforce the laws of the United States in any State by the ordinary course of judicial proceedings, he may call into Federal service such of the militia of any State, and use such of the armed forces, as he considers necessary to enforce those laws or to suppress the rebellion.

10 U.S.C. §253. Interference with State and Federal law

The President, by using the militia or the armed forces, or both, or by any other means, shall take such measures as he considers necessary to suppress, in a State, any insurrection, domestic violence, unlawful combination, or conspiracy, if it—

(1) so hinders the execution of the laws of that State, and of the United States within the State, that any part or class of its people is deprived of a right, privilege, immunity, or protection named in the Constitution and secured by law, and the constituted authorities of that State are unable, fail, or refuse to protect that right, privilege, or immunity, or to give that protection; or

(2) opposes or obstructs the execution of the laws of the United States or impedes the course of justice under those laws.

The italicized portions here make plain why Bob and I once concluded that the Insurrection Act is “a dangerous, centuries-old federal statute that authorizes the president, with few restraints, to deploy the U.S. military inside the United States to suppress threats the president perceives to the constitutional order.” The power authorized here is astounding.

The third circuit just issued an 8th Amendment and ADA opinion that found a pro se complaint generally stated claims against a variety of defendants. The facts are rather disturbing, as is the fact that the district court dismissed with prejudice.

A lot going on here, but a religion note: DHS Assistant Sec. Tricia McLaughlin refers to Rev. Black as a "pastor" here — using quotation marks.

It's a notable slight against a faith leader's status, as Black is, in fact, an ordained minister of a church operating within the Presbytery of Chicago.
This footage is from almost a month ago. What this clipped video doesn’t show is that these agitators were blocking an ICE vehicle from leaving the federal facility—impeding operations. 

Over and over again, law enforcement ordered these agitators to move off of federal property so the vehicle could move. Law enforcement verbally warned these agitators that they would use force if they did not move and stop impeding operations. They did not comply. 

Shortly after, rioters began throwing rocks, bottles and launching fireworks at the law enforcement officers on the roof. 
 
At the time of this incident, this facility held criminal illegal aliens including gang members, drug traffickers, and other violent criminals. Obstructing law enforcement puts officers, detainees and the public at risk. If you are obstructing law enforcement you can expect to be met with force. 
 
And, as an aside, this is the same “pastor” who flipped 
@Sec_Noem
 and our team the bird when we were there last week.

As I read it, the 9th Circuit's administrative stay of the 1st TRO in Portland allows federalization of the Oregon National Guard troops for now *but still bars deployment of any NG troops in Portland.* That's because 2d TRO was not appealed & barred deployments of any federalized NG troops.

The US has a system of legalized unaccountability. Most people seem totally unaware that there is *literally nothing* in law that can protect you once federal authority is invoked. Not local authorities, state authorities, civil suits. The system entirely assumes good faith from the top.

The bipartisan, unanimous panel (Clinton/Trump/Trump) says Trump still can’t deploy OR NG bc he didn’t appeal her 2nd TRO.
