what I find dumb is that the underlying lesson taught (clarify what people mean when they say things, engage when the definition of something is contested, etc.) is entirely defensible, but many people internalized it as "move the goalposts and win :)"

This isn't how judicial power works. Courts can't "enjoin" or "restrain" the President from launching a nuclear strike on Congress. If a private party is injured by the nuclear strike, that party can bring a lawsuit. The legality and constitutionality of the action will be adjudicated. And compensat

I have no fucking idea what Ilan is even talking about here, or even whether he's tracking the litigation. The issue is whether POTUS complied with a statutory delegation of power under 10 USC 12406, to nationalize the fed guard. His lawyers aren't even arguing commander in chief power.

Republicans had pledged not to allow taxes to go up, but they will. The deal will see small businesses in particular paying higher taxes than they would have otherwise. There are some spending cuts, but not enough to off-set the massive increases fueled by now-expired federal COVID grants. Democrats were able to maintain funding for free breakfasts and lunches for all schoolchildren, regardless of their needs. Michigan is not such a prosperous state that it can afford to buy meals for well-off families. But Democrats were unshakeable in their demands to continue this handout.
