How do these agencies work? They license bulk feeds from newswire distributors (e.g., Reuters, AP), partner with broadcast monitoring hardware (TVEyes), or tap public APIs for online news/social.

Google Books let you search inside a book to decide if you need it, but it won't replace the book. TVEyes made it possible to search film clip databases, etc. That's not clearly present in AI training use.

And there's not really any case on using stuff to make a thing to make competing works.

On the alleged harm to the market for licensing AI training, Alsup again does the right thing: there is no legit market interest in licensing transformative uses, so no harm. Fourth factor favors fair use for training.

But isn't ML distinguishable based upon how much of the data it retains? TVEyes kept a copy of everything and allowed users to make clips from it. ML would process everything and retain only a small portion of the data.
