SALISBURY, N.C. (QUEEN CITY NEWS) - Two U.S. citizens claim they were detained and forcibly removed from their vehicle by federal immigration agents on Jan. 5, after arriving at a work site where two employees of a local construction company had been taken into custody by ICE.
Edwin Godinez, 29, and Yair Alexander Napoles, 22, went to retrieve a company truck after two workers - Adelso Perez Sales and Alejandro Domingo Ambrosio Bamaca — were detained earlier that morning in Salisbury.
Godinez and Napoles allege that ICE agents surrounded their vehicle, told them to stop recording, and removed them from their car while questioning their citizenship.
Both men say they are U.S. citizens.
"We demand that these agents stop abusing our community," Godinez said in a statement. "They are arresting hardworking people, not hardened criminals."
Napoles said agents questioned his citizenship despite his explanation that he was born in Roxboro, North Carolina.
"They kept saying, 'You're not a citizen, you're not a citizen, to me, even when I told them I was," added Napoles.

SALISBURY, N.C. (QUEEN CITY NEWS) - Two U.S. citizens claim they were detained and forcibly removed from their vehicle by federal immigration agents on Jan. 5, after arriving at a work site where two employees of a local construction company had been taken into custody by ICE.

These delays are particularly shocking considering what competency restoration treatment actually entails. As the U.S. Supreme Court has recognized, the competency requirement has the “modest aim” of ensuring only that the defendant “has the capacity to understand the proceedings and to assist counsel.” See: Godinez v. Moran 509 U.S. 389 (1993). To this end, competency restoration services are not akin to actual mental health treatment. Rather, as a recent law review article explains, “competency restoration often includes just medication sufficient to achieve temporary psychiatric stability such that a defendant can retain information.” This, the article continues, is supplemented with “a cursory lesson about court proceedings and how the criminal justice system functions.” A defendant is considered competent once they can “parrot back this basic information,” even if it is not fully understood.
