The judgment has now been published, link below. Worth noting that the Legacy Act amendments will restore the ability to bring civil actions, on a lower standard of proof, and that Soldier F isn't the subject of a witch hunt - he was undoubtedly deep in the wrong:

A day where law and justice feel far apart. But criminal law really struggles to function at 53 years of remove, when so many witnesses are dead. Injustice was assured when it took this long for the state to recognise its wrongdoing and start proceedings:

ICERD, ICCPR, ICESCR, CEDAW, CAT, CROC, CRPD all relevant!! #ICJ says #humanRights obligations outside its own territory, esp in OT applies with respect to all these treaties. CIL also applies. Wide range of human rights apply & are relevant to OPT pop'n. All alongside #IHL occupation obligations.

Of all the news in this NYT survey of sitting federal judges - incl 47 of them think the SCt is mishandling its emergency docket - maybe the biggest is that 65 sitting fed judges (37D, 28R), folks circumspect for a living, responded to a NYT survey. Stunning. And a sign that something is very wrong.

Worth noting: Quote simply echoes US anti-ICC sanctions' statutory prerequisite. 1st step in 2025 & 2020 alike was presidential declaration whole institution (ICC)=threat to national security of US or its allies (see my post ⬇️). Should've been more attention to/pushback against that 1st time 'round.
