Es ist schon krass, tatsächlich steht im KoaVertrag drin, dass der Amtsermittlungsgrundsatz im Asylprozess durch den Beibringungsgrundsatz ersetzt wird. Das ist rechtsstaatlich in jeder Hinsicht unhaltbar.
Wir setzen auf eine deutliche Beschleunigung der Asylverfahren – sowohl beim Bundesamt für Migration und Flüchtlinge als auch bei verwaltungsgerichtlichen Verfahren. Dabei werden wir auch die Rechtsmittelzüge in den Blick nehmen und ermöglichen die Einrichtung von besonderen Verwaltungsgerichten für Asylrechtssachen. Aus dem „Amtsermittlungsgrundsatz“ muss im Asylrecht der „Beibringungsgrundsatz“ werden. Nach einer Ausweisung oder einer Abschiebung soll grundsätzlich ein Einreise- und Aufenthaltsverbot angeordnet werden.
