The school district here previously tried notice-and-opt-out and it was such an administratively unworkable burden they created the policy that was challenged in this case.
There was a robust record IN THIS CASE showing that the practical result was no LGBTQ books.
There was a robust record IN THIS CASE showing that the practical result was no LGBTQ books.
Although Alito frames the remedy here as "notice and opt-out," the reality is that school districts cannot manage such a sweeping opt-out system. They are far more likely to simply pull books with LGBTQ characters off classroom shelves altogether rather than face a ruinous, high-profile lawsuit.

Thinking today of that John Dingell quote “[i]f I let you write the substance and you let me write the procedure, I’ll screw you every time,” but that can’t possible be what the Court is up to, right?
