International law does contain specific definitions of what constitutes an international armed conflict or a non-international armed conflict. This is a good thing, because rules around what States can do are more permissive when there's an actual conflict.

It would depend on where the boats are registered! Venezuela's a party to the Rome Statute, so I would think yes, at least the territorial basis for ICC jurisdiction would be satisfied if that's where they're registered.

The rule of law means that civilians who commit crimes are prosecuted in courts of law with benefit of due process. Extrajudicial executions in international waters are an affront to our Constitution and the law of nations. It isn’t national defense. It’s murder.

Today, we had a superb lunch talk about AI, human learning, and the future of legal pedagogy and practice from @jvagle.me. Mindblowingly good. Not to sign Jeff up for more work, but send him whatever invites you have.

He’s radically reframed how I think about AI, but dare I say I’m more concerned!
