My take on the "unique historical tradition" nonsense is that it prevents Congress from restructuring every agency to match the Fed's structure.
This bespoke exception for the Fed is one of the most brazenly made-up things I've ever seen the Supreme Court do (which is saying something). There is no principled basis to distinguish the Fed from other independent agencies. The conservative justices just don't want Trump to crash the market!
The Supreme Court goes out of its way to say that its order today does NOT allow Trump to remove members of the Federal Reserve because it is "uniquely structured" and has a "distinct history tradition." (I do not think those distinctions hold water.) www.supremecourt.gov/opinions/24p...

Nice write-up. In religion cases you can always tell which way justices are leaning based on how much they talk about free exercise versus how much they talk about no establishment.
Wednesday’s SCOTUS oral argument, at which the majority appeared likely to OK nation's first religious charter school, was not an ending. It, more likely, would just be another crushed Establishment Clause limit. Until the next one.

HAPPENING NOW: DHS official tells court that agency diverted 10-20 employees to run *1.3 million* names of foreign students through database that tracks criminal charges. Took 2-3 weeks.

There were ~6,400 hits (0.004%). But thousands were for charges that never led to convictions or were dropped.

PSA: Pretrial detainees have not been convicted of anything and are entitled to the presumption of innocence.
6th Cir. holds that it was not clearly established law that a prison official could not throw a volleyball at the head of a pretrial detainee with force sufficient to bruise his face to get him to shut up. Declines to establish such law.
