State defense forces you advocate for would similarly be used as rationale to go in.

There is no cutesie legal manuever that stops where this is heading.

We're already on that ratchet. The only way out is thorough.

Yes it would. You're doing the work of the fascist to say they can't refuse federalization or federal orders. Make them try to enforce it.

This isn't an impediment to Trump. They can refuse illegal federalization.

Absolutely. There’s currently a federal occupation of the Twin Cities. Trump already escalated and will threaten further escalation no matter what happens.
This is why any talk of "not taking the bait so they won't escalate" was always a fantasy.

They can say no to federalization under the belief that it is an illegal order.

And if is really the case that they would side with the fascists (which doesn't make sense given voting trends among service members), then you're screwed either way. Might as well try and know for sure.

Federalization isn't automatic, and they can be instructed to disobey illegal orders.

Like, a governor should be saying “here’s what the state is doing to aid & protect you. Here’s how we’re coordinating with local govt & nonprofits to do that. Here’s how we’re coordinating with other states.”

Note that in the previous post, the assumption was he was going to use the National Guard to protect people.

Then we see who is loyal to the Constitution and who is loyal to a traitor.

humans are apes, technically.

Disobeying an order to federalize is also legal until a court rules otherwise.

Haven't you seen how long it takes to resolve these disputes in court?
January 15, 2026 at 5:19 AM
That is illegal, and hopefully Walz already had conversations about loyalty and their duty to disobey illegal orders.
