It’s quite relevant if you want to discriminate on the basis of sex. The pond can either be a mixed sex space or a single sex space.

A lawful trans inclusive policy would be a mixed sex pond (men and women).

Trans rights are protected. These never included access to spaces for the opposite sex.

That case isn’t going to be heard by the ECHR.

The European Court of Human Rights only hears cases that have exhausted all domestic legal remedies, and since McCloud wasn’t a party to For Women Scotland in the Supreme Court, she can’t do this.
