Imagine trying to interpret the First Amendment by the practices under the Articles of Confederation. The whole point of the Constitution was that politics under the Articles didn’t work, and the whole point of the Bill of Rights was that the Constitution didn’t protect people&: rights enough.

Apart from the fact the leader of the right mocked Reiner, one small difference is that Reiner's day job was making movies that people loved, while Kirk's starting point was creating enemies list of professors to be fired or harassed. These are not the same things.

This is a startling read of history & precedent. He has a lot to distinguish. But for him, Supreme Court precedent isn't very relevant when its not tied to originalist reasoning? & the Alien & Sedition Acts are *positive* evidence for how to interpret the 1st Am? Bring back seditious libel, anyone?

One way that the reaction to Rob Reiner's murder mirrors Charlie Kirk's is that the best way to eulogize each of them is to quote their words, and in both cases, doing so pisses off conservatives.
