The weirdness here about the as-applied argument: the bigot argument is basically that there aren't enough trans-athletes to sustain a challenge.

One thing that's always been true about Sotomayor is that she, more than any other justice, focuses on the litigants before her. All the others focus more on the larger legal issue of the case, but Sotomayor never takes her eye off the ball of the people involved.

I’ve honestly never been more bullish on ACA subsidy extensions than I am right now. Lots of House Rs broke ranks, and Senate Rs are realizing the midterms will be a bloodbath if they don’t do the same.
But the narrative remains:
It was the Democrats who saved health care.
