Jack Smith, special counsel in Trump cases, resigns
Smith has spent the last two months winding down the two federal criminal prosecutions of Donald Trump and had indicated he would resign before inauguration.

Merchan explaining that he wants to nail this jerk but can’t.
Merchan: To be sure, it is the legal protections offered by the OFFICE of the presidency that is extraordinary. Not the OFFICE HOLDER.

And it is my obligation to consider mitigating and aggravating factors for any defendant before me.

I think the Jack Smith draft report is finished. Write to Merrick Garland and ask him to release the Jack Smith report. You can do it here. Select “Messages to the Attorney General” from the drop down menu www.justice.gov/doj/webform/...

This is what bothers me the most. Entire office disqualified. It’s so unnecessary and so impractical. Talk about throwing the baby out with the bath water.
But the court’s decision to remove Fani Willis from the prosecution means that her entire *office* is disqualified from the case. So, the line attorneys who have been working on this for 3+ years can’t just step in.

But Georgia does have a process for what happens next.

Look bringing back polio sounds bad. But it’s a small price to pay to get rid of pronouns in email signatures and black women in star wars.

Pretty crazy someone can be charged federally with interfering in an election and those charges get dropped because they win an election.

I appreciate Smith’s continuing passion and ethics. Like many others who devoted tons of time following these cases, I’m so disappointed TFG won’t face justice. But having a big “maybe” hanging over his head for 4 years is a consolation. Thank you, Jack.
Jack Smith says Office of Legal Counsel opinions require dismissal, now but permit dismissal *without* prejudice--meaning a new indictment could theoretically be returned after Trump's term (with an argument for tolling of the statute of limitation).

Though Jack Smith's motions to dismiss today don't mention writing a report to the AG, the regulation under which he was appointed *requires* that he do so. Though initially "confidential," the AG can choose to make it public—as AG Garland did with both the Hur and Durham reports.

It’s his moment. I hope he lives up to it.
If Jack Smith writes a report and Garland releases it, that's actually a pretty baller move: releasing a report on an incoming president. If he doesn't release it, I'll join y'all in calling him an ineffective jerk.

This is not the worst-case scenario. There is one that is worse. I don’t want to get into it but it involves cannibalism and giant lasers.
