Calling the press “fake news” is harmful. Calling them “seditious, perhaps even treasonous” for publishing reporting is something else entirely. Treason is a capital crime. Suggesting journalists should face it for exercising their First Amendment rights and doing their jobs is dangerous.

Ismael Ayala-Uribe came to the US at 4 yrs old & worked down the street from my parents house where he was detained in an immigration sweep. He died in ICE custody from lack of medical care.

This man died from being at the wrong place at the wrong time because of #IceLawlessness, cruelty & racism.

1/ ACIP’s meeting last week was disgraceful, unprepared, & chaotic. They voted to roll back the universal #HepB birth dose despite no evidence of harm, and pushed an antibody test that doesn’t reliably guide decisions. The practical effect of overturning Humphrey’s will be that Republican presidents can stack the formerly independent agencies with their copartisans and SCOTUS will be cool with everything they do but when a Dem POTUS does the same Roberts et al will declare all those agencies’ actions unlawful.
In a memo John Roberts wrote just 4 yrs out of law school, he said the “time may be ripe to reconsider the existence” of independent agencies & bring them back into the executive branch. Now he’s poised to end what he has long called “a constitutional anomaly.”

Kagan's line of questioning here was pretty much Gorsuch's music to invoke the nondelegation doctrine, which he then jumped in and did.

Remember: this case isn't about making Trump king. This case is part of FedSoc's generational project to destroy the fed gov't's regulatory power.
Kagan: formal arguments should not blind us to the real-world realities of what our decisions do.

When we place all these agencies under complete presidential control...we are left with "a president with control over everything, including over much of the law-making" in this country.

In 2016, Whiskey Pete Hegseth bluntly warned that Trump would push unlawful military orders and abandon anyone who refused to break the law for him. These people weren’t fooled; they saw the risk to the country and the military.

They chose complicity over integrity, and they’re still doing it.
