TLP analyses & comments on UK law that affects trans people's lives and rights. We can't advise on individual cases. Deeply opposed to UKSC/FWS ruling of 16/4/25 & to its blatant exploitation to hurt trans people subsequently. www.translegalproject.org

Needs to be widely shared with cisgender people, especially politicians. Utterly horrifying that Britain has come to this- that most of Britain is just looking the other way while a whole community is being eliminated from society because of lies and hatred. transactual.org.uk/wp-content/u...

Absolutely chilling.

The Council of Europe Commissioner for Human Rights, Michael O’Flaherty, conducted a visit to the United Kingdom from 30 June to 4 July 2025, and a report was released today, including his thoughts on the state of trans rights in the UK at the moment.

Graphic with a pink to purple gradient background. It says "he Council of Europe Commissioner for Human Rights said today that he "is concerned about the current climate for trans people [in the UK]. ... He deplores that discussions tend towards the exclusion of trans people from many aspects of society, rather than ensuring that their inclusion and dignity are upheld." EHRC initially claimed these 'briefing sessions' weren't part of the Consultation - it's unclear what status they actually had. We took the view that they probably weren't planning to listen; our aim was to hear their attempts to defend their views. They didn't do well.
translegalproject.bsky.social
Having been doing battle with them for some time, we told them we wanted an invite. Basically to hear what possible legal justification they might have for their incoherent guidance plus the chance to say what we thought about it to them, which we did. More here: www.translegalproject.org/blog-1

Many legal protections for trans people do not depend on having a GRC; these protections include access to single sex spaces. See Croft v Royal Mail [2003] - the Supreme Court explicitly reaffirmed a key principle in it.
translegalproject.bsky.social
Thank you. I hope they meet with you. Please do keep in mind another strand of the whole mess. FWS did NOT invalidate important case law that protects trans people's rights, including of access. In fact the ruling explicitly referred to it still standing. The EHRC is completely ignoring this.

Yet another human rights organisation #TheLemkinInstitute calls out the UK on trans and intersex rights following the Supreme Court ruling.

The Lemkin Institute for Genocide Prevention and Human Security would like to bring attention to and condemn recent judicial and governmental developments in the United Kingdom, which attempt to harm transgender and intersex people in the UK by stripping them of privacy and segregating them as ‘others.’ The Lemkin Institute believes these moves are part of a broader process of erasure. It is not only government action but also the media narrative that has fuelled hostility to and debate about the humanity of trans and intersex people while ignoring their voices. We see evidence of genocidal intent and actions targeting these communities.

In April this year, the United Kingdom’s Supreme Court (UKSC) delivered a judgment declaring that, for the purposes of the Equality Act (2010), “sex” refers to “biological sex,” which it did not define clearly. The Equality Act (2010) provides protection against discrimination on a variety of grounds in public spaces. This ruling at the UK’s highest court means that individuals are now protected from discrimination on the basis of their assigned at birth sex, regardless of how that corresponds to their gender identity, lived gender, or sex characteristics. The decision is the result of a court challenge brought by the gender critical group For Women Scotland, which is financially backed by author J.K. Rowling and characterises itself as “feminist.”

Although I didn’t get to speak to my MP or a member of the HOL I was glad to be part of this momentous occasion. I spoke to lots of passionate, caring, interesting people.

Big shout out to all parents there, with, or on behalf of, their trans children.

We need a fair future for all trans people.

To the Committee on Legal Affairs and Human Rights and the Sub-Committee on Human Rights,

The undersigned are organisations which advocate for the human rights of trans people in the United Kingdom. We are writing to express our grave concerns about the developing situation regarding trans people's human rights in this country and to ask the Committee to take action.

Following a decision of the UK Supreme Court in April, the Equality and Human Rights Commission - the UK's National Human Rights Institution - has issued an interim update which encourages and in some cases mandates the exclusion of trans people from single-sex spaces and services, in violation of their human rights. This has been followed by draft guidance which seeks to make such an approach statutory. The EHRC has made clear that it is not seeking input on its legal approach, only on how this approach is best communicated.

The draft guidance, if it were to become law, would impose an obligation on employers and service providers to implement a bathroom ban on trans people using toilet and changing facilities in line with their acquired sex, instead requiring in practice that they use only gender neutral facilities. Such gender neutral facilities are frequently unavailable, and mandating their usage may require trans people to out themselves. The guidance would also prohibit associations for women and lesbians operating on a basis which would allow trans women to participate, even if the association desires to do so. This would also be true for men's organisations wanting to include trans men.

This draft guidance is being consulted on in the wider context following For Women Scotland, in which government ministers and public bodies have made comments about trans people's rights. The UK Minister for Women and Equalities has stated that trans people are required to use the toilets associated with their sex as recorded at birth, even where their change in sex is recognised by a Gender Recognition Cer… In Christine Goodwin v UK, the European Court of Human Rights held that refusing to legally recognise the lived sex of trans people and placing them into an 'intermediate zone' where they are not quite one sex or the other was a violation of their right to respect for private life under Article 8 of the Convention. This protection was reaffirmed by the Court in the very recent decision of T.H. It is a core principle of the Convention that rights must be practical and effective, not theoretical and illusory.

We believe that in the UK, trans people are being returned to this 'intermediate zone', placing the State - once again - in violation of its positive obligations under the Convention. The legal recognition afforded by Gender Recognition Certificates is now illusory, and inapplicable to practical lived realities of trans people in this country.

We ask that the Council of Europe take immediate action to protect the human rights of trans people in the UK. We ask that you conduct a report into the state of trans human rights in the UK. We note that the situation is urgent and that without intervention, it seems likely to further deteriorate.

Kind regards,

Finally built up the strength to tackle the EHRC consultation this weekend? You’ll find material on how wrong it is in law here. Why not add some of this to your own personal take?

The mass lobby of Parliament showed what this community & allies are capable of. Let’s kill these EHRC proposals.

Thanks to everyone who came to the mass lobby organised by @transsolidarity.bsky.social, calling on MPs to oppose the EHRC’s harmful draft guidance.

If you missed it, don’t worry, you can still speak with your MP about trans rights - just send them an email requesting a meeting.

On way home from @transsolidarity.bsky.social mass lobby in Westminster. Queued 4 hours with my husband, Alice’s dad, to green card my MP, who we knew was unavailable , but waited 90minutes in case a member of her team would come and talk to us. My message: keep the gender police out of our toilets.

Someone really really needs to get into the Courts on this. Our view is that the UK Parliament hasn't a prayer on defending its actions. Even in the face of the most transphobic judiciary in 50 years. Helpful if an individual might be able to take it forward?
