As the Supreme Court continues to delay issuing a ruling on tariffs, the Constitution remains as clear as ever. Article 1, Section 8, lists the "enumerated powers" reserved exclusively to Congress, including the power to levy duties (tariffs).
Only Congress, not the President, can set tariffs.
