The other way that the District could have justified the policy is to argue that non-targeted “use of biological pronouns (ugh) constitutes a denial of students’ right to an education.

I think the District could plausibly have met this standard, but … they didn’t try.
Turning to Tinker's violation-of-rights prong, the School District all but concedes that it has not shown that the use of biological pronouns would violate the rights of any students under Title IX— the federal law barring a school's deliberate indifference to student-on-student sexual harassment. Appellees' Supp. Br. 20-21; see Saxe, 240 F.3d at 210. Title IX bars only speech (typically combined with conduct) that is "so severe, pervasive, and objectively offensive that it denies its victims the equal access to education that Title IX is designed to protect." Davis, 526 U.S. at 652. And the School District lacks evidence that the use of biological pronouns would deny any students an equal access to education in this way. See Meriwether, 992 F.3d at 511. The School District responds that transgender and nonbinary students have a right to be free from "harassment" and "bullying" under Ohio law. Ohio Rev. Code § 3313.666(B)(1); see Appellees' Supp. Br. 11. But this argument suffers from similar problems. Again, the District is right that it has the same power to discipline students for bullying or harassing transgender classmates that it has to discipline students for bullying or harassing other classmates for other reasons-whether their bodily appearances, unusual names, or religious affiliations. But again, the District is wrong to equate the speech here (the use of biological pronouns) with the bullying and harassment that it may prohibit. Ohio law defines "harassment, intimidation, or bullying" to cover speech directed at another student only if the speech both "[c]auses mental or physical harm to the other student," and "[i]s sufficiently severe, persistent, or pervasive that it creates an intimidating, threatening, or abusive educational environment for the other student." Ohio Rev. Code § 3313.666(A)(2)(a). And the School District has offered no evidence that the commonplace use of biological pronouns would create an intimidating, threating, or abusive environm…

Case: 23-3630 Document: 60 Filed: 10/02/2023 Page: 26 The district court also erred in reasoning that a student's general use of particular pronouns in his day-to-day speech invades the rights of others under Tinker. It is undisputed that the student speech Parents Defending Education seeks to protect is the general, untargeted use of pronouns consistent with students' "religious or scientific beliefs that biological sex is immutable and that individuals cannot transition from one sex to another." PDE, 2023 WL 4848509, at *4. That is a far cry from the "serious or severe bullying or harassment targeting particular individuals" envisioned by the Supreme Court in Mahanoy, 141 S. Ct. at 2045, and it is the exact opposite situation envisioned by the Fifth Circuit (later relied upon by the Supreme Court in Tinker) in Blackwell. After all, in Blackwell, the students invaded the rights of other students by compelling them to speak. See Blackwell, 363 F.2d at 753, 754. In this case, the district court argued it would invade the rights of others not to compel students to speak. That argument defies logic and has no basis in Blackwell or Tinker. Finally, the district court's contention that a student choosing to use a certain pronoun does not "express a personal belief about gender identity" simply has no basis in law or fact. PDE, 2023 WL 4848509, at 18 Case: 23-3630 Document: 60 Filed: 10/02/2023 Page: 27 *15. The last decade of American jurisprudence is replete with cases demonstrating that Americans have strongly held convictions about gender identity, homosexuality, and LGBT issues at large. See, e.g., Meriwether v. Hartop, 992 F.3d 492, 499 (6th Cir. 2021) (professor declined to refer to a student as a female "because his sincerely held religious beliefs prevented him from communicating messages about gender identity that he believes are false"); Masterpiece Cakeshop, Ltd. v. Colo. C.R. Comm'n, 138 S. Ct. 1719, 1727 (2018) ("[The religious and philosophical objections to gay marriage are protected views and in some instances protected forms of expression . ..."); Saxe, 240 F.3d at 203 (student sincerely believed "that homosexuality is a sin"). And Parents Defending Education has repeatedly and consistently represented in this case that its members have "sincerely-held religious or scientific beliefs that biological sex is immutable and that individuals cannot transition from one sex to another." PDE, 2023 WL 4848509, at *4. By compelling Parents Defending Education's student members to speak against their convictions, Olentangy is requiring them to "affirml ... a belief and an attitude of mind" they do not share.
