Pretty wild to me how many pundits and academics treated Republican opposition to the notion of Supreme Court expansion during the Biden administration as a serious, principled stance, as opposed to a position Republicans would obviously abandon the moment it became convenient

Journalists should explain the implications of Berger's radical view: it means that only the General Assembly gets to decide what is and what isn't constitutional. That's clearly not how our democracy was ever intended to function.

Utah is the third state in the past decade where Republicans have packed their supreme court.

Arizona and Georgia Rs did it in 2016 to secure right-wing majorities.

North Carolina Rs tried it in 2018 to prevent the Dem court from overturning their gerrymanders, but voters rejected their power grab
This hasn’t received nearly enough attention:

Republicans just passed a law to pack Utah’s Supreme Court after it ruled against their congressional gerrymander.

Cox could appoint two more justices before the court hears the GOP’s latest appeal to preserve their gerrymander

Once the new seats are filled, Gov. Spencer Cox will have appointed five of the seven justices.

In Utah, all of the judges are Republican appointees. Cox has appointed the majority already. But the court has rejected abortion bans, a voucher program, and now the legislature wants two new judges in place before a crucial gerrymandering case comes up, hoping to reverse a lower court ruling.

Republicans have also expanded state supreme courts in Arizona and Georgia. A Democratic trifecta should have zero compunction over expanding a hijacked, runaway SCOTUS that has actively undermined democracy, enabled extreme gerrymandering and become the true source of the right’s political power.
My guess is that there will be very little pushback against Governor Cox for this, and that as he positions himself for 2028, he will do so by presenting himself as the moderate, sane voice of the GOP. But this is straightforwardly undermining a check on more radical policymaking.
The Utah governor just signed a bill to expand his state's supreme court by two seats.

Conservatives have been angry at a series of judicial rulings, including one that safeguarded direct democracy in 2024 & one that struck down their gerrymander. 1st step of their retaliation.

The thing that shocks me most is that all of this incriminating stuff was sitting at the DOJ for 4 years and Biden & Garland were not cynical or ruthless enough to use it against Trump & Musk in the run up to 2024.

Republicans have advanced a bill to pack Utah’s Supreme Court in response to its rulings against their congressional gerrymander.

It fits into a wider pattern of Republican court-packing: Arizona’s and Georgia’s GOP did it in 2016, and North Carolina’s GOP tried it in 2018 but was blocked by voters
The Utah Senate has passed a bill that would expand the state supreme court by 2 seats (to be filled by the GOP governor).

This comes as local conservatives are angry about judicial decisions in Utah, inc. one that safeguarded direct democracy in 2024 & one that struck down their gerrymander.
