This is a good example of how politics has become a team sport. These people are about winning, scoring points and supporting the team. Nothing else matters. MAGA offers more entertainment to him, so he's rooting for MAGA. That's what politics is these days, and it's not just a right-wing problem.

Again, unanimous decision. They stuck with the past 100 years of 1A analysis that "Congress shall make no law" means Congress shall make no law. You can punish arson. You can punish trespassing. You just can't punish someone for being a racist asshole*.

Expanding the court until it changes its views on the First Amendment is unlikely to pay off. Among other things, liberals value the First Amendment too. Consider RAV v St. Paul. The Supreme court unanimously struck down a law criminalizing *cross burning*.

I mean, I could go on Twitter and find MAGA accounts and say things like "Trump got covid and looked sooo scared hahahahaha loser" and post pictures of my vaccination records. I guess that would be owning the rights, but why would I want to do such a thing?

Laugh if you will, but sometimes those consultants earn their fees simply by stopping the client from doing something stupid. The correct answer might well have been "just drop the +, my dudes, it's confusing. Just focus on Apple and TV and stop trying to be cute"

In any case, relying on Schenck is misplaced. The new standard is much higher. Some speech can be deemed dangerous, but only if it's likely to result in imminent lawlessness. Keyword is "imminent". Not contributing to some future possible harm.

That case was overruled by Brandenburg, but that hasn't stopped other states from using that logic. Trump wants to jail anyone who burns a flag or identifies as Antifa because some ideas are just dangerous to society. That's the standard you're proposing we rely upon.

I’d have more sympathy for Covid vaccine skeptics if they didn’t offer such stupid alternatives. Coronavirus vaccines aren’t as effective or durable as other vaccines. Some of the newer variants aren’t that dangerous.

Some states would move to criminalize all sorts of left wing and right wing speech. SCOTUS would have a chance to reopen a lot of historical freedoms. Some states would like to revisit the whole freedom of religion thing.

How would you even create this? It’s a nice goal, but you’d have to amend the constitution to do it. At present, Congress shall make no law abridging freedom of press or speech. No law. You’d have to change that. The second you open that can of worms, they would be a rush to take power.

Also, any body that sets policy would be subject to Presidential authority to set direction, plus there’s no way to mandate the appointees would indeed be bipartisan. This is a weakness of our constitutional system. There is no good way to create a genuinely independent agency.
