The founders expressly considered and rejected legislative super majorities. The filibuster has no constitutional cover at all. If Reid had dumped it when he should have we would have a public option under the ACA, and very possibly M4A by now.

The Supreme Court is famously leery of telling other branches how to do their business. It most certainly should weigh in here, but I have no confidence that it will do so given the extremist make up of this court. I sure wish Obama had fought harder for that seat.
You have a lot more faith in GOP rule following than I do, and I still haven't found the actual house rule. We will see, I mean that we can't really avoid.

Interesting. This threatens the American Experiment but you don't think it has anything to do with the topic. I think it has everything to do with it. On what you've posted so far why would a Republican House ever have to seat a Democratic member? That's kind of the point here.
Not a single person, including you, has cited to a house rule. They have names and numbers. I'm going through them trying to find it, so far without success. If it allows the speaker or a party to overrule a constitutional result, than it's an unconstitutional rule and should be challenged.

Sorry you think it's tiresome. Johnson says he won't seat her until Senate Democrats cave on the CR. That's the situation we're in and I think it demands a very public response.

I especially liked the concluding line of that article. "Politically, the optics are brutal: refusing to seat a member for leverage is a gun aimed at the fundamentals of representative democracy."
I just read that and still see no house rule here, just norms and customs. If the speaker or a party can refuse to seat indefinitely, then that negates a constitutional provision, not a legal result. The House has been in session several times but refused to seat her. Time to bring this to a head.

Let me add I did find the controlling statute, which says the Speaker should swear her in. But even the statute does no purport to be the only way, and federal judges have been used many times in many places to swear in new members. If you have found a house rule, please cite me to it.
What house rule is that? There's a constitutional provision that requires the oath. That's it. The issue would be the cloud of confusion Johnson would raise, but at this point no one is even citing to any house rules. We're two weeks down the road. Doing nothing is not working.

Dems need to show up with the oath, a federal judge to administer it and a pen for her to sign. Then hand the signed oath to the clerk of the House and she should take her seat.

This is a lot like Obama giving McConnell the power to defeat his SCOTUS nomination by taking no action. C'mon man!

Why the delay?

Perhaps it's because Grijalva would cast the final vote needed to release the Epstein files.
