that's been the most frustrating thing to me - basically this formula has been - Feds claim Portland is on fire, feds send in NG to stop the fire that doesn't exist, fire is gone, so the courts say it's because of the feds

Judge Nelson says the determination is "not all driven by what we see on the streets," suggests that there is behind-the-scenes information that we don't have.

Chaffin: on this record, there was not evidence that sporadic violence was a rebellion to justify federalizing the NG.

I think the one argument that wasn't connected for me is that Oregon said things began calming down in September. The judge attributed it to sending in the feds. But Trump didn't deploy a large group til the end of Sept, I thought.

I've been following the Lattarulo case involving the seizure of an immigration attorney's cell phone at Logan Airport (complaint: storage.courtlistener.com/recap/gov.us...) pretty closely and I'm left with a big question that none of the coverage has answered.

"Both conditions apply here" -- homeland security said in filing that they're needed in Chicago because "there is a rebellion or danger of rebellion" against the US - and Trump can't "execute the laws of the US" with current law enforcement
Excerpt of court case reads: First, Plaintiffs have failed to make a strong showing of a likelihood of success on the merits.Under 10 U.S.C. § 12406, the President is authorized to call up members of the National Guard into federal service when “there is a rebellion or danger of a rebellion against the authority of the Government of the United States” or when “the President is unable with the regular forces to execute the laws of the United States.” 10 U.S.C. § 12406(2)–(3). Both conditions apply here: The violent actions and threats by large numbers of protestors, directed at those enforcing of federal immigration laws and at federal property, constitute at least a danger of a rebellion against federal authority and significantly impede the ability of federal officials to enforce federal law.
