IF this DOJ were smart, they'd let the Comey case go. It's a dog case anyway, and then the judge won't have to issue another opinion w/ findings about all the misconduct in the grand jury investigation.

also I simply do not think this is a conversation that plays well for them in public, because it naturally gravitates towards "what do you mean by illegal orders" and then people start worrying about what "obey literally any order" actually means

Every Democrat in Congress should put out a video saying troops have an obligation to refuse unlawful orders. Make them prosecute all of you. This isn't a close call.

I try not to sound super confident about normal legal issues because law is weird and you've got to do the leg work to get the right answer, but in the Trump era I'm even less confident than usual. I never even considered that an AG could try to appoint an SGA to get around a ruling like this.
