Puisque les comparaisons avec la IVe sont de retour, en cas de nouveau blocage du PLF[SS] cette année, rappelons qu'il existe bien une procédure conçue par MM. Debré et de Gaulle pour de pareilles circonstances :

Article 47, al 3 de la Constitution de 58 : « Si le Parlement ne s'est pas prononcé dans un délai de soixante-dix jours, les dispositions du projet peuvent être mises en vigueur par ordonnance. »

Extrait du discours de M. Debré au CE présentant cesdites dispositions : « Cette description de la nouvelle procédure législative ne serait pas complète si elle n'était suivie de l'indication des règles précises que le projet fixe à la procédure budgétaire. Le temps des débats est limité pour les deux chambres et les amendements qui diminuent les recettes ou augmentent les dépenses sont interdits. Quand le temps des débats est écoulé - à condition que le budget ait été déposé en temps voulu -, le Gouvernement peut promulguer la loi de finances. Les expériences que nous avons vécues depuis trop d'années justifient cette procédure qui peut paraître brutale à qui ne connaît pas la brutalité semblable de tous les régimes parlementaires disciplinés. »

Well here in France it's 1 per 120 citizens or so—around 550 thousand elected local councillors for 68 million people.

But the structure of local government here is fundamentally different and centralised, and we don't have "specialist"/administrative elected offices like municipal clerks.

I would argue that this is isn't just a bad hunch. It retaliates for protected speech. Generally it's hard to prove such a case since officials don't normally say "we are doing this to you because you are black/gay/saying things we don't like" but here Mr Trump helpfully is trying to do just that.

I suppose the argument could be made that only the US Congress but not any of the state legislatures has the power to arrest those outside of its chamber and to detain them in contempt of the legislature. (Whether or not the 10th Amendment changes something however, I don't know).

"The questions ... expressed ... without unnecessary detail. The questions should be short and should not be argumentative or repetitive."

The question:

Questions Presented / In Obergefell v. Hodges, “five lawyers closed the
debate,” and imposed “an act of will, not legal
judgment. The right it announce[d] had no basis in
the Constitution.” 576 U.S. 644, 687 (2015) (Roberts,
J., dissenting). “[T]the Court read a right to same-sex
marriage into the Fourteenth Amendment, even
though that right is found nowhere in the text.” Davis
v. Ermold, 141 S. Ct. 3, 3 (2020) (Thomas, J.,
Statement). As predicted at the time Obergefell was
decided, it “would threaten the religious liberty of
many Americans who believe that marriage is a
sacred institution between one man and one woman.”
Id. “As a result of this Court’s alteration of the
Constitution, Davis found herself with a choice
between her religious beliefs and her job. When she
chose to follow her faith . . . she was sued almost
immediately for violating the constitutional rights of
same-sex couples.” Id. And, after being sued, she was
thrown in jail for doing so and then faced a jury
verdict of $100,000 (plus $260,000 in attorney’s fees)
based solely on emotional distress damages for “hurt
feelings” with no actual damages in her individual
capacity because the lower courts held that she was
entitled to no First Amendment protection. If ever a
case deserved review, the first individual who was
thrown in jail post-Obergefell for seeking
accommodation for her religious beliefs should be it.
The Questions Presented are:
(1) Whether the First Amendment Free Exercise
Clause provides an affirmative defense to tort liability

based solely on emotional distress damages with no
actual damages in the same manner as the Free
Speech Clause under Snyder v. Phelps, 562 U.S. 443
(2011).
(2) Whether a government official stripped of
Eleventh Amendment immunity and sued in her
individual capacity based solely on emotional distress
damages with no actual damages is entitled to assert
individual capacity and personal First Amendment
defenses in the same or similar manner as any other
individual defendant like in Synder v. Phelps, 562
U.S. 443 (2011), or does she stand before this Court
with no constitutional defenses or immunity
whatsoever.
(3) Whether Obergefell v. Hodges, 576 U.S. 644
(2015), and the legal fiction of substantive due
process, should be overturned.

What I think the franchise needs is a Grade 6 lawyer (I think that's a GS-14/15 in the US?) as his line manager who gives him reading on New Public Management, procurement, cost benefit analysis, and sends him to IPT and SIAC hearings to get him off her hands.

The facts of the French case are very similar: two influencers claimed that Mrs Macron is a transgender person, and that she lied about her past to hide that fact.

As far as I can gather (no opinion online) the French court found the claims factually false but that the defamation wasn't actionable.

I should probably add that Mrs Macron caused for a defamation case to be brought here in France, where she lost on appeal (and is seeking certiorari).

The source I've seen suggests several interesting points in the court's reasoning but I can't find a reliable copy of the decision for now.
