i just want to point out that, in doing so, lower courts are upholding their duty to faithfully apply the constitution and laws--and oftentimes, controlling supreme court precedent
this is why gorsuch is complaining about lower courts defying SCOTUS. a lot of communication between SCOTUS and lower courts is informal, especially in re: shadow docket cases, and SCOTUS has been sending unmistakably clear signals to roll over for trump. and lower courts have responded “make me”
guys like Alito and Thomas are such fucking outliers among the federal judiciary, even among GOP appointees. most of these people are bright, care that they are perceived that way, and have a legitimate decades long commitment to the legal tradition.
